Welcome!

We've drafted these Terms of Service (which we call the "Terms") so you'll know the rules that govern our relationship with you as a user of Actually Hangout and any of our other products or services that are subject to them (which we refer to collectively as the "Services"). Our Services help you plan and organize hangouts with friends – because real connection happens in person.

Although we've tried our best to strip the legalese from these Terms, there are places where they may still read like a traditional contract. There's a good reason for that: these Terms form a legally binding contract between you and Actually Hangout, Inc. ("Actually Hangout," "we," "us," or "our"). So please read them carefully.

By using any of our Services, you agree to the Terms. If so, Actually Hangout grants you a non-assignable, non-exclusive, revocable, and non-sublicensable license to use the Services in accordance with these Terms and our policies. Of course, if you don't agree with the Terms, then don't use the Services.

ARBITRATION NOTICE: THESE TERMS CONTAIN AN ARBITRATION CLAUSE. YOU AND ACTUALLY HANGOUT AGREE THAT, EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THAT ARBITRATION CLAUSE, DISPUTES BETWEEN US WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND YOU AND ACTUALLY HANGOUT WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. YOU HAVE THE RIGHT TO OPT OUT OF ARBITRATION AS EXPLAINED IN THAT ARBITRATION CLAUSE.

1. Who Can Use the Services

Our Services are intended for users who are 16 years of age or older. You must confirm that you are 16 years or older to create an account and use the Services. If we have actual knowledge that you are under the age of 16, we will cease providing the Services to you and delete your account and your data.

By using the Services, you represent, warrant, and agree that:

  • You can form a binding contract with Actually Hangout;
  • You are at least 16 years of age;
  • You are not a person who is barred from using the Services under the laws of the United States or any other applicable jurisdiction;
  • You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

If you are using the Services on behalf of a business or some other entity, you represent that you are authorized to bind that business or entity to these Terms and you agree to these Terms on behalf of that business or entity.

In summary: You must be at least 16 years old to use Actually Hangout. If we learn you're under 16, we will delete your account and data.

2. Rights You Grant Us

Our Services let you create content, such as your profile information, group names, hangout details, and location data when you use Pin Drop. When you do that, you retain whatever ownership rights in that content you had to begin with. But you grant us a license to use that content.

For all content you create using the Services, or submit or make available to the Services, you grant Actually Hangout and our affiliates a worldwide, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, adapt, publish, and distribute that content. This license is for the purpose of operating, developing, providing, and improving the Services and researching and developing new ones.

While we're not required to do so, we may access, review, screen, and delete your content at any time and for any reason, including to provide and develop the Services or if we think your content violates these Terms or any applicable laws. You alone remain responsible for the content you create or store through the Services.

We always love to hear from our users. But if you provide feedback or suggestions, just know that we can use them without compensating you, and without any restriction or obligation to you.

In summary: You own your content, but you give us permission to use it to provide and improve the Services. You're responsible for the content you create.

3. Privacy

Your privacy matters to us. You can learn how your information is handled when you use our Services by reading our Privacy Policy. We don't sell your data or show you ads – we're here to help you spend time with friends, not monetize your attention.

4. AI Features

Our Services include AI-enabled features ("AI Features"), specifically our "Set it & Send it" feature, which uses text you provide ("Inputs") to help you create hangout details ("Outputs").

Our AI Features are powered by Anthropic. When you use AI Features, your Inputs are sent to Anthropic to generate Outputs. We collect aggregated, anonymized usage data from AI Features to improve our Services, but we do not use your Inputs to train AI models.

Important limitations: While we integrate certain safeguards into AI Features, Outputs may not always be accurate, complete, or appropriate. AI Features and Outputs are provided as-is without warranties of any kind. You should review any AI-generated content before using it.

When using our AI Features, you agree not to:

  • Submit Inputs that violate these Terms or applicable laws;
  • Attempt to circumvent any safety features or safeguards in the AI Features;
  • Misrepresent Outputs as having been created without the use of artificial intelligence.

In summary: Our AI features help you plan hangouts, but you should review the suggestions before using them. Don't try to misuse the AI or bypass its safeguards.

5. Your Account

To use our Services, you need to create an account. You agree to provide us with accurate, complete, and updated information for your account, including your first name, last name, and phone number.

You are responsible for any activity that occurs in your account, so it's important that you keep your account secure. If you think that someone has gained access to your account, please contact us immediately.

You agree not to create any account if we have previously removed or banned you or your account from any of our Services, unless we consent otherwise.

In summary: Keep your account information accurate and your account secure. You're responsible for what happens on your account.

6. Your Contacts

With your permission, we access your phone's contact list to help you find friends who are already using Actually Hangout. You can revoke this permission at any time in your device settings. If you want us to delete the contacts you've already shared, you can contact us or delete your account.

7. Location Data

When you use Pin Drop to share your location with friends, we collect and store your location data. You can choose to share your precise location or a general area. Location data is stored on our servers until you delete your account.

You control when you share your location and with whom. Never put yourself or others in harm's way to use our location features.

8. Respecting the Services and Our Rights

As between you and us, Actually Hangout is the owner of the Services, which includes all related brands, works of authorship, software, and other proprietary content, features, and technology.

You must respect our rights and may not do, attempt to do, enable, or encourage anyone else to do any of the following:

  • Use our branding, logos, or designs except as explicitly allowed;
  • Violate or infringe Actually Hangout's or any third party's intellectual property rights;
  • Copy, modify, distribute, sell, or lease any part of our Services;
  • Reverse engineer, decompile, or attempt to extract the source code of our software;
  • Use any automated means to access or scrape our Services;
  • Use the Services in a way that could interfere with or damage the Services;
  • Upload viruses or malicious code;
  • Attempt to access areas of the Services you're not authorized to access;
  • Use the Services to create a competing product; or
  • Violate any applicable law in connection with your use of the Services.

In summary: We own the Services. Don't try to copy, hack, or misuse them.

9. Respecting Others' Rights

You may not use the Services in a manner that violates or infringes someone else's rights. When you submit content to the Services, you agree and represent that you own that content or have the necessary permissions to use it.

10. Safety

We try hard to keep our Services a safe place for all users, but we can't guarantee it. By using the Services, you agree to comply with these Terms and all applicable laws.

If you fail to comply, we reserve the right to remove any offending content, terminate or limit your account, and notify third parties – including law enforcement – if necessary.

We also care about your physical safety. Do not use our Services in a way that would distract you from obeying traffic or safety laws. Never put yourself or others in harm's way to use Actually Hangout.

In summary: Help us keep the Services safe. Don't use Actually Hangout in ways that could harm yourself or others.
